Complaints can be complex and costly and very often an employer is exposed for not having appropriate policies and procedures, or not following their stated grievance procedures. Employment law specialist solicitor Sean Ormonde will outline what process issues usually lead to liability in the WRC, or in applications under the Health & Safety Act 2005. Dr Roisin O' Shea and Shane Dempsey of Arc Mediation, with over 300 cases completed to date, will outline why mediation should be offered early as part of an effective Grievance procedure, and what are the likely benefits for the employer.

Dr. Roisin O’Shea – Dip, BA (Hons Law), PhD, Mediator

Róisín is a founding partner of Arc Mediation. She is an expert in Family Law, Employment Law, and has significant experience as a mediator completing over 330 cases since 2009 including family, work-place and commercial mediations for private and public sector clients.

Róisín is a board member of the Mediators Institute of Ireland (MII). She is also engaged in ongoing research in the field of mediation at Waterford Institute of Technology (WIT), and she delivers briefings and training on mediation to Bar Associations, third-level students and mediators. In March 2017, Dr O’ Shea and her colleague Dr Conneely were invited by the Department of Justice as “relevant stakeholders” to make submissions on the Mediation Bill 2017, commenced on January 1st 2018. Dr O’Shea is a consultant to Friarylaw and delivers MII-approved Civil and Commercial mediation training.

Shane Dempsey – Dip, BSc, MSc, Mediator

Shane Dempsey is a trained and practicing mediator since 2008, and is a founding partner of ARC mediation established in 2010. Shane has mediated over two hundred agreements in family, workplace and commercial cases for clients including SMEs, multinationals and public sector. He is a member of the Irish Commercial Mediation Association (ICMA) and has developed a reputation for innovative solutions to the thorny problems of agreeing asset valuation and division upon the dissolution of partnerships.

Shane has conducted research and presented at international conferences, including AFCC, about how best to measure the effectiveness of the mediation process in terms of results, time, effort & cost. This ongoing research and practical experience of commercial and workplace mediations informs the accredited Mediation training course he delivers in association with Friary Law.
